Staff Recommendation:
1. James M. McInerny is permanently incapacitated for the performance of duties and a disability retirement should be granted.
2. James M. McInerny’s disability is service-connected based on the claimed injury(ies)/disease as listed in Exhibit A; therefore, grant a service-connected disability benefit.
3. Staff shall initiate disability benefit payments with an effective date of January 30, 2021, the day after the last day of regular compensation.

Mr. McInerny is the spouse of Chief Financial Officer Amy McInerny. Under Benefits Policy No. 028 (Processing SBCERA Employees and Trustees and their Immediate Family Members Disability Retirement Applications and Related Appeals), the Chief Executive Officer is to ensure that his application will be handled without bias from staff. The Chief Executive Officer (CEO) was notified of the submission of Mr. McInenry’s application. After discussions with Chief Counsel Barbara Hannah and Disability Retirement Supervisor Dawn Peterson, the CEO determined that the application could be processed internally fairly and without bias.
