BACKGROUND:
This month’s Chief Counsel Executive Report is a follows:
1. Confidential Disability Retirement Status Report.
2. Confidential & Privileged SBCERA - Brown Act Requirements.
3. Update Re Court of Appeal Case Los Angeles County Employees’ Retirement Association v. County of Los Angeles and Board of Supervisors (Case No. B326977)
a. SBCERA Amicus Brief in support of LACERA
b. Court of Appeal opinion filed June 24, 2024 (Case No. 2024 WL3100166) Court found in favor of LACERA and held the following:
i. County employee retirement board had the authority to hire the personnel it deemed necessary to fulfill the board’s fiduciary responsibility for administration of the system, including the number and type of personnel and their compensation;
ii. Constitutional provision giving county employee retirement board plenary authority over the county retirement system did not conflict with County’s home rule authority; and
iii. County board of supervisors had a mandatory statutory duty to include in county classifications and salary ordinance the employment classes and compensation adopted by retirement association board for their employees.
