Requested Benefit:
1. Service-Connected Disability Retirement

Staff Recommendation:
1. Jennifer Deshon is permanently incapacitated for the performance of duties and a disability retirement should be granted.

2. Jennifer Deshon's disability is service-connected based on the claimed injury(ies)/disease as listed in Exhibit A; therefore, grant a service-connected disability benefit.

3. Staff shall initiate disability benefit payments with an effective date of October 7, 2023, the day after the last day of regular compensation

BACKGROUND:
At the January 9, 2025 Board meeting, the Board granted applicant's request to continue the matter to the February 6, 2025 Board meeting to dispute the effective date. After the January Board meeting, applicant's attorney informed staff of continuing scheduling conflicts. At the February 6, 2025 Board meeting the Board continued the matter to the May 1, 2025 Board meeting, per request of the applicant's attorney. Mr. Treger contended that Ms. Deshon, that there were no doctors who could determine the permanency of Ms. Deshon's incapacity and thus entitled to an earlier effective date than the date of application. At the April 3, 2025 Board meeting, the Board approved Benefits Policy No. 036 regarding effective date. Based on the policy, staff reviewed the matter in light of the guidelines of the Benefits Policy No. 036 and determined the facts support granting an earlier effective date which the day after the last day of regular compensation because there was inability to ascertain the permanency of her incapacity until after the last day of regular compensation.
