Requested Benefit:
1. Service-Connected Disability Retirement with Supplemental Retirement Allowance
Staff Recommendation:
1. James Miller is permanently incapacitated for the performance of duties and a disability retirement should be granted.
2. James Miller's disability is service-connected based on the claimed injury(ies)/disease as listed in Exhibit A; therefore, grant a service-connected disability benefit.
3. James Miller is not capable of gainful employment; therefore, grant the supplemental disability retirement allowance.
4. Staff shall initiate disability benefit payments with an effective date of March 18, 2024, date of application.

Attorney - Jane Oatman, Esq. - Faunce, Singer & Oatman
This matter was continued at the request of the Applicant and Applicant's attorney from the May 1, 2025 Board meeting to the August 7, 2025 Board meeting, in order to provide specific additional information regarding the Applicant's employment. Staff received additional information from Applicant's attorney on July 15, 2025, and requested additional time to review and vet the material, recommending continuing the matter to the October 2, 2025 Board meeting. Based on review of additional information received, staff recommends granting a service-connected disability retirement with supplemental disability allowance.
