SUBJECT: Authorization to conduct July Board and Committee meetings without compliance with paragraph (3) of subdivision (b) of Government Code section 54953
RECOMMENDATION:

Pursuant to SBCERA Resolution No. 2021-7, find that the State of Emergency continues to directly impact the ability to meet safely in person and therefore continue conducting the SBCERA Board and Committee meetings in the month of July in a hybrid format.

BACKGROUND:
At the October 7, 2021 meeting, the SBCERA Board adopted SBCERA Resolution No. 2021-7 acknowledging the proclamation of a State of Emergency by Governor Newsom and Assembly Bill 361 Authorizing Remote Teleconference Meetings of the SBCERA Board. Government Code section 54953 (e)(3) requires the Board to make findings by majority vote every 30 days for continued authorization to teleconference without compliance with section 54953 paragraph (3) subdivision (b):
The SBCERA Board has reconsidered the circumstances of the State of Emergency and one of the following circumstances exist:
(1) The State of Emergency continues to directly impact the ability of the members to meet safely in person.
(2) State or local officials continue to impose or recommend measures to promote social distancing.
State of Emergency means a State of Emergency proclaimed pursuant to Section 8625 of the California Emergency Services Act.
