BACKGROUND:
General Policy No. 005 involves the periodic review of Board policies and indicates that the review shall be every three years.
Pursuant to General Policy No. 005, staff has conducted a review of Administration Policy No. 007 and has found that minor updates needed to be made to the Policy. The reference to Tort Claims Act of 1963, has been renamed to Government Claims Act (Government Code section 810). The amount limits for filing Small Claims Court actions have increased to $12,500; Limited Civil Jurisdiction increased to $35,000; and Superior Court minimum amount has changed to $35,001. Therefore, the Claim form for SBCERA has been updated to reflect the new amounts for filing of claims within the proper jurisdiction.
Staff therefore is recommending renewal of Administration Policy No. 007 with minimal substantive change.
COMMITTEE REVIEW:
This item was reviewed by the Administrative Committee at its September 18, 2025 meeting, and recommends Board approval with a 4-0 vote. Trustee Stafford participated in the absence of Trustee Hatch.
