Requested Benefit:
1. Supplemental Retirement Allowance
Staff Recommendation:
1. Maintain the initial board decision from December 6, 2018 that the member is permanently incapacitated for the performance of duties based on the claimed injury(ies)/disease as listed in Exhibit A; therefore, was granted a service-connected disability benefit.
2. The member was found to be capable of gainful employment; therefore, was denied the supplemental disability retirement allowance.
3. Helen Smith may proceed to an Administrative Review provided a written request is submitted in accordance with the Rules of the Procedures for Disability Retirement Applications and Formal Hearings, understanding that the hearing officer will hear the request benefits de novo, unless otherwise stipulated by the parties.
BACKGROUND:
On January 14, 2019, member requested Administrative Review and Reconsideration of the Board of Retirement decision. Member requested to be put on payroll for what the Board granted her pending the appeal of her requested benefit.
Additional information was due June 6, 2019 for the Administrative Review and Reconsideration of the Board of Retirement decision; however, member provided no new evidence.
