Requested Benefit:
1. Service-Connected Disability Retirement
2. Supplemental Retirement Allowance
Staff Recommendation:
1. Maintain the initial board decision from December 6, 2018 that the member is not permanently incapacitated for the performance of duties based on the claimed injury(ies)/disease as listed in Exhibit A; therefore, was denied a service-connected disability benefit.
2. The member was found to be capable of gainful employment; therefore, was denied the supplemental disability retirement allowance.
3. If disability retirement is determined at a future hearings stage, the effective date will be April 16, 2016, the day after the last day of regular compensation.
4. Maria J. Escobedo may proceed to an Administrative Review provided a written request is submitted in accordance with the Rules of the Procedures for Disability Retirement Applications and Formal Hearings, understanding that the hearing office will hear the request benefits de novo, unless otherwise stipulated by the parties.
BACKGROUND:
On December 19, 2018, member requested Administrative Review and Reconsideration of the Board of Retirement Decision.
On December 19, 2018, additional information was provided by the member to SBCERA.
Based on the review of the additional information provided by the member, the medical advisor, Dr. Shoaib Naqvi, found no reason to change his original medical recommendation dated September 12, 2018.
At the 8/1/2019 Board meeting, the Board granted an extension to the September 5, 2019 Board meeting per the member's request.
