Staff Recommendation:
1. Correct the effective date of Jhocelyn Diaz Reyes’ service-connected disability benefit, where the Board previously granted an effective date of April 29, 2019.
2. Staff shall initiate disability benefit payments with an effective date of May 25, 2019, the day after the last day of regular compensation as determined by staff.
BACKGROUND:
On March 5, 2020, the Board found Ms. Diaz-Reyes was permanently incapacitated for the performance of duties and that her disability was Service-Connected; therefore, the Board granted a Service-Connected disability benefit. The effective date to commence the payment of the disability benefit was based on the application date of April 29, 2019. After an audit of Ms. Diaz-Reyes’ account was performed, it was determined that the correct effective date for benefits should be May 25, 2019, the day after the last day of regular compensation. Because the audit was performed prior to her first payment date, there is no overpayment to Ms. Diaz-Reyes.
