Requested Benefit:
1. Service-Connected Disability Retirement
Staff Recommendation:
1. Edna Zelinski is permanently incapacitated for the performance of duties and a disability retirement should be granted.
2. Edna Zelinski’s disability is service-connected based on the claimed injury(ies)/disease as listed in Exhibit A; therefore, grant a service-connected disability benefit.
3. Staff shall initiate disability benefit payments with an effective date of the day after the last day of regular compensation as determined by staff.

Attorney - Jane Oatman, Esq. - Faunce, Singer & Oatman
Staff recommends a grant of a service connected disability retirement benefit in opposite of Dr. Hector’s recommendation that Ms. Zelinski is not disabled. Based on the evidence presented herein there is substantial evidence to support a finding that Ms. Zelinski is permanently incapacitated and Ms. Zelinski’s incapacity is service connected.
