Requested Benefit:
1. Service-Connected Disability Retirement
Staff Recommendation:
1. Justin Nielsen is permanently incapacitated for the performance of duties and a disability retirement should be granted.
2. Justin Nielsen's disability is service-connected based on the claimed injury(ies)/disease as listed in Exhibit A; therefore, grant a service-connected disability benefit.
3. Staff shall initiate disability benefit payments with an effective date of December 22, 2018, the day after the last day of regular compensation.
BACKGROUND:
At the January 9, 2020 Board meeting, the board granted an extension to April 9, 2020 for the member to submit an amendment to his application. At the May 7, 2020 Board meeting, the board granted another 6-month continuance for the member to amend his application. After review of Dr. Mohr's report, staff agrees that there is a real and measurable connection between Mr. Nielsen's permanent incapacity and employment; therefore, Mr. Nielsen is entitled to a service connected disability retirement.
