Requested Benefit:
1. Service-Connected Disability Retirement with Supplemental Retirement Allowance
Staff Recommendation:
1. Pam Vance is permanently incapacitated for the performance of duties and a disability retirement should be granted.
2. Pam Vance’s disability is non-service connected based on the claimed injury(ies)/disease as listed in Exhibit A; therefore, grant a nonservice-connected disability benefit.
3. Pam Vance is capable of gainful employment; therefore, deny the supplemental disability retirement allowance.
4. Staff shall initiate disability benefit payments with an effective date of December 17, 2022, the day after the last day of regular compensation.
BACKGROUND:
This matter is in closed session because the Applicant is permanently incapacitated, but there is not a real and measurable connection between the incapacity and employment. Therefore, staff recommends granting a nonservice-connected disability retirement based on the injuries cited in Section II of Exhibit A. In addition, Applicant is capable of gainful employment and therefore, the recommendation is to deny the supplemental retirement allowance.
